Terms of use

These General Terms and Conditions for the provision of services govern the relationship between Café de l’Homme.

 

These general terms govern the relationship between the company Café de l’Homme, a French SAS with a share capital of €40,000, registered with the Paris Trade and Companies Register under number 478 343 304, and its clients, in the context of remote sales of tourism and leisure services.

We invite you to read these terms carefully, as they contain essential legal provisions and constitute the contractual basis of any reservation made with Café de l’Homme.

Any confirmed order constitutes full and complete acceptance of these general terms and conditions.

Users of the website acknowledge having read these terms and agree to comply with them unreservedly.

Website Terms and Conditions of Use

By accessing the website www.cafedelhomme.com, you agree to comply with these general terms of service, which are immediately applicable.

If you refuse to accept them in full, you must not use this site or proceed with a reservation.

Café de l’Homme reserves the right to modify these terms at any time. Updates will be published online; it is your responsibility to review them regularly to stay informed.

Continued use of the website following updates constitutes acceptance of the revised terms.

You agree to use the website only for lawful purposes, without infringing the rights of third parties or hindering access to or proper use of the site by other users.

Authorized Use

The website www.cafedelhomme.com is intended for strictly personal and non-commercial use, or for the purpose of submitting legitimate reservation requests.

Any use for fraudulent, speculative, or automated purposes (robots, scrapers, etc.) is strictly prohibited without prior authorization.

By accessing the site, you declare and warrant that:

  1. You have not been suspended or banned from accessing the site;
  2. You are not a direct competitor of Café de l’Homme;
  3. You only maintain one active account at a time;
  4. You have the legal right to accept these terms and are not in violation of any third-party agreements.

Intellectual Property – Eiffel Tower Lighting

The client is informed that the image of the illuminated Eiffel Tower is protected under copyright and trademark law.

The Eiffel Tower is owned by the City of Paris, while the SETE (Société d’Exploitation de la Tour Eiffel) holds a public service delegation granting it the management of intellectual property rights related to the image of the Eiffel Tower, including its night-time lighting.

The “Original Lightings” (golden, sparkling, etc.) are protected works, and their use requires prior written authorization from SETE.

In the event of any reproduction (photos, videos, etc.) that includes these lightings, the client must submit a request to the following email address:

This request must include the client’s full identity (name, mailing address, email address) as well as all information related to the intended use (type of medium, objective, duration, distribution, etc.).

User Accounts

Certain features of the website require the creation of a personal account. By creating an account, you agree to:

  • Provide accurate information;
  • Be solely responsible for its use;
  • Not share your access or create fake profiles;
  • Not use an email address that does not belong to you.

Café de l’Homme reserves the right to terminate any user account at any time, without justification, particularly in the event of non-compliance with these terms.

Payment

The client who provides their credit card information, including via the internet, unconditionally accepts the general terms and conditions of service.

This communication does not constitute immediate billing. The charge is only made after confirmation of availabilityand the issuance of a voucher, sent via email or post. An invoice can be provided upon request.

A credit card hold may be required to secure certain reservations (e.g., menus, gift vouchers).

Accepted payment methods: Mastercard, Visa, American Express, and JCB.

Payments made by credit card are free of any additional fees or commissions.

Full payment or a credit card guarantee is required to confirm a reservation.

The transaction will appear on the client’s bank statement under the name CAFÉ DE L’HOMME.

No refund will be issued once the service has begun.

Group Payment Terms

  • Prices listed on our quotes are firmly established on the date of order and remain valid throughout the option period.
  • These rates may be adjusted depending on seasonal variations or economic conditions. Final confirmation is required once the option period ends.

Additional Services

Any additional service (e.g. beverages, products, services) not included in the initial quote will be billed separately, subject to prior agreement with the client on the day of the event.

Payment Terms

Unless otherwise agreed:

  • Deposit: 50% of the total quote amount including VAT, payable upon validation (“Approved for agreement”).
  • Balance: Payable on the day of the event, including any additional charges.

In the event of late payment, penalties equal to 1.5 times the legal interest rate and any applicable fees will apply by default and without formal notice.

In case of non-payment, Café de l’Homme reserves the right to suspend any ongoing order or reservation, without prejudice to further legal action.

Claims and Penalties

  • No claims related to the service will be accepted after it has been performed.
  • Any dispute regarding an invoice must be submitted within 8 days of issuance.

In accordance with Article L441-6 of the French Commercial Code (Law n°2008-776 of August 4, 2008 – Art. 92), a late payment interest equal to three times the legal rate will be applied to any overdue payments.

A €40 fixed collection fee will also be charged, in accordance with current regulations.

Reservation Conditions

To secure any reservation, we require either a credit card guarantee or prepayment, especially for special events.

By making a reservation, the client expressly accepts the established payment terms.

The client may cancel their reservation at any time within the allowed time frame, usually via the cancellation link in the confirmation email.

Any cancellation made at least 24 hours before the scheduled time entitles the client to a full refund of any prepaid experience, with no service fees.

In case of late cancellation (less than 24 hours prior) or no-show, a cancellation fee equal to the full value of the booked experience will automatically be charged.

For details on fees, please refer to the section “Cancellation or changes made by the client” further below in these terms.

Group Reservation Conditions

Any order or reservation made by a client implies full and unconditional acceptance of these terms and conditions.

Only specific provisions of a signed contract between the client and our establishment may complement, specify, or override these terms.

Reservations are considered final and confirmed only upon receipt of the signed quote with the mention “Approved for agreement”, and a deposit of 50% of the total amount.

For all seated lunch and/or dinner menu orders, an identical menu choice for all guests must be communicated at least 5 business days prior to the service date.

Reservation Rules and Guest Policy

  • Reservations including children under the age of 15 are not accepted for the dinner service. Thank you for your understanding.
  • Pets are not allowed, except for duly identified assistance dogs.
  • A smart casual dress code is required. Open-toe shoes for men are not permitted.
  • As our establishment operates in two seatings, your table is reserved for a limited time, indicated in your confirmation email. It must be vacated at the end of that period to accommodate guests for the next service.
  • In the event of a delay, your table will be held for a maximum of 15 minutes past the scheduled reservation time.
  • We will do our best to honor your seating preferences, but table allocation is subject to availability and cannot be guaranteed.
  • In case of force majeure or exceptional circumstances beyond our control, we reserve the right to cancel your reservation. No compensation may be claimed in such cases.
  • Please respect the comfort and experience of all guests, especially when taking photos.
  • The use of professional equipment and flash is prohibited to preserve the ambiance of the venue.
  • It is strictly forbidden to consume any outside food or beverages within the premises.

Payment Processing

Café de l’Homme is committed to providing high-quality service. As such, only amounts related to confirmed bookings at the time of the order will be charged.

No amount will be charged to the client’s credit card for unconfirmed services.

In the case of additional charges, the client’s express agreement is required prior to any extra billing.

Payment is processed exclusively under these conditions, and fund transfers are carried out in accordance with the instructions issued by Café de l’Homme.

Payment Confidentiality and Security

Café de l’Homme uses the services of Sunday and Stripe, two reputable payment processors known for their reliability and secure transaction handling.

All bank data confidentiality is fully managed by these providers, who are solely responsible for the transfer and processing of such data.

To ensure a high level of security, an SSL (Secure Socket Layer) protocol is used to encrypt all transmitted data. This system guarantees optimal protection for online transactions.

Café de l’Homme declines all responsibility in the event of transmission failures or loss of confidential data due to a technical malfunction beyond its control.

Pricing

Unless otherwise specified, prices displayed on the website are per person and shown in euros, inclusive of all taxes (VAT included).

Payments are made exclusively in euros. If the client chooses physical delivery (registered mail, Chronopost, etc.) of gift vouchers or experiences instead of email delivery, shipping fees may be charged in addition to the total service cost.

Prices do not include:

  • Tips left to the waitstaff;
  • Personal requests or services;
  • Any item not explicitly mentioned in the “What’s included” section of product pages.

Prices shown online are indicative only and do not constitute a contractual commitment from Café de l’Homme.

They may differ from the final charged amount, especially due to external factors (exchange rates, service provider fees, taxes, etc.).

Any temporary promotional offers are not included in the standard listed prices.

Price Validity

Prices are valid at the time they are posted online, and unless otherwise stated, apply for the current season.

Café de l’Homme reserves the right to change its pricing without notice.

Vouchers / Exchange Vouchers / QR Codes

Following your reservation, a confirmation will be sent to you by email.

Clients must be able to present this document (printed or digital version) during any check, especially at the time of service. If not, access to the reserved services may be denied, with no possibility of refund.

Vouchers, exchange vouchers, and QR codes issued by Café de l’Homme are valid for 12 months from their date of purchase, subject to availability.

If the total amount of selected services exceeds the value of the voucher, the client must pay the difference on-site, either in cash or by credit card accepted by the establishment.

Café de l’Homme Gift Cards

Café de l’Homme gift cards are exclusively redeemable on the website www.cafedelhomme.com and can be used for any available online product or service.

Gift cards are valid for twelve (12) months from the date of purchase.

  • If the value of the reserved services exceeds the value of the gift card, the client may pay the difference by credit card on the website.
  • If the value of the purchase is less than the gift card, the card will be considered fully used: no credit or partial refund will be granted.

Gift cards can never be exchanged for cash.

Café de l’Homme reserves the right to cancel any fraudulently obtained gift card. It declines all responsibility in the event of loss or theft of a gift card.

All gift card sales are final. Gift cards are non-refundable and can only be redeemed based on availability at Café de l’Homme.

Deposit

Payment of a deposit by the client, in the context of a large table reservation (5 guests or more) or menu order, constitutes a firm and final commitment.

This deposit represents a first installment “to be deducted” from the reserved service and constitutes a contractual agreement from the client.

In accordance with applicable law, no cancellation or waiver will result in a deposit refund, regardless of the reason.

Our Experiences

Café de l’Homme, its team, and partners support you from concept to personalization of your menu, as part of a custom-designed experience.

Any reservation of 7 guests or more requires a pre-selected menu, to be defined with our sales team.

For individual reservations or small groups, we offer five types of experiences:

  • The Eiffel Experience – from €300 per person, includes personalized welcome, front-row seating with the best guaranteed table, unlimited Charles Heidsieck Blanc de Blancs Champagne, amuse-bouches, a three-course à la carte experience, a table reserved for the entire evening, and souvenirs to take away.
  • The Diamond Experience – from €220 per person, includes guaranteed second-row seating, a glass of Charles Heidsieck Blanc de Blancs Champagne, amuse-bouches, a three-course à la carte experience, and a souvenir to take away.
  • The Premium Experienceavailable only for groups of 7 to 12 people, starting at €150 per person for an indoor experience, or €190 per person for an outdoor experience.
  • The À la Carte Terrace Experience – with a €60 supplement per person, includes terrace seating, a glass of Charles Heidsieck Brut Champagne, and a guaranteed view of the Eiffel Tower.

Geographical Scope of the Offer

The offers provided by Café de l’Homme via its website are intended for an international clientele. The general terms and conditions of sale remain valid in most countries. No claims will be accepted in the event of delivery delaysconcerning gift cards or vouchers sent to the client.

Availability

Café de l’Homme endeavours to serve its clients to the best of its abilities. Nevertheless, the services offered by Café de l’Homme are subject to the availability of tables. No compensation may be claimed by a client should the chosen service not be available. Café de l’Homme shall not have any obligation to provide services whose availability it cannot guarantee. Should the services chosen by the client not be available, Café de l’Homme shall endeavour to provide a solution that is as near as possible to the client’s request.

In that case, should the client be dissatisfied with the proposed service, he shall be entitled to obtain a full refund of the initial purchase price with the exception of services booked on special dates, for which Café de l’Homme might not know the rates at the time of putting the information online.

Notwithstanding the foregoing provisions, should Café de l’Homme be informed in advance about a significant change in a booking, product or event, it shall do everything reasonable to warn its clients in order to modify the booking whenever possible.

Modification or Cancellation by the Provider

Café de l’Homme strives to ensure the proper execution of its services and cannot be held liable in the event of force majeure, exceptional circumstances, or external events (e.g., strikes, breakdowns, third parties, etc.).

In the event of a modification affecting a key element of the service before the experience date, the client will be informed and will have 7 days to choose one of the following options:

  • Cancel the reservation by email only, with a full refund of the amounts paid;
  • Accept the proposed modification. In this case, an updated voucher will be sent, along with an email detailing the changes made, including any possible price variation (increase or decrease).

Cancellation or Modification by the Client

In case of cancellation, the client must notify Café de l’Homme by email or via the cancellation link provided in the confirmation email.

The date of receipt of the email will determine the official cancellation date and the applicable cancellation fees, if any.

In the event of a no-show or late cancellation, 100% of the prepaid experience amount will be retained by the establishment, with no possibility of refund or compensation.

Penalty fees applied via the bank guarantee in case of no-show or late cancellation are non-refundable and non-transferable to another service, regardless of the reason.

Any unfulfilled reservation will be considered consumed by the client and does not entitle them to any refund, rescheduling, or credit.

Any request to reschedule after a late cancellation must be made in writing by email only and be justified by an exceptional case. Such requests will be reviewed as a goodwill gesture by our teams but do not entitle the client to a reschedule, refund, or credit.

In case of late cancellation (less than 24 hours before the reservation) or no-show, the following cancellation fees will be automatically charged. These correspond to the full price of the reserved experience, namely:

  • €300 per person for the Eiffel experience
  • €220 per person for the Diamond experience
  • €150 per person for the Premium experience
  • €120 per person for the Eiffel Lunch experiences,
  • €75 per person for the Diamond Lunch experiences,
  • €60 per person for the Terrace experience
  • €25 per person for CDH by Night experiences

For à la carte indoor reservations, specific fees also apply:

€50 per person for dinner service, and €30 per person for lunch service

For special dates such as December 24 & 31, February 14, July 14, or any other special event:

  • Up to 90 days before the event: Full refund of the reservation, minus €50 handling fee per reservation.
  • Between 60 and 30 days before the event: 50% of the reservation amount will be retained as cancellation fees.
  • Less than 30 days before the event: No refund possible, the full amount of the reservation will be charged.

Descriptions

Café de l’Homme strives to provide the most accurate information possible regarding the products offered, as well as the descriptions related to neighborhoods or public places shown on its website.

The illustrations, visuals, and services presented on the site are for informational purposes only and may be changed at any time, including menus. Similarly, the mentioned characteristics may also be modified. These changes can under no circumstances be considered grounds for claims or discounts.

Photographs and visuals illustrating the products are non-contractual. In case of error or inaccuracy on the site, Café de l’Homme shall not be held liable.

All content on the site (texts, images, drawings, descriptions, etc.) is and remains the exclusive property of Café de l’Homme. It may not be used or reproduced by third parties without express authorization. Some images may be sourced from royalty-free image banks, with authors credited where possible.

While the accuracy of the published information is regularly verified, Café de l’Homme does not guarantee:

  • uninterrupted access to the site,
  • the absence of errors or defects in the content,
  • the immediate correction of any detected anomaly,
  • nor the absence of viruses or bugs on the site or its hosting servers.

Availability

Café de l’Homme endeavors to meet client expectations as best as possible. However, the services offered are subject to the availability of tables and services.

No compensation will be granted if a reserved service is ultimately unavailable. Café de l’Homme has no obligation to provide a service it cannot guarantee.

If the initially selected service is not available, Café de l’Homme will offer an alternative option as close as possible to the original request. If the client does not accept this new proposal, they may request a full refund, except for services booked on special dates, where pricing conditions may not be known at the time of listing.

In the event of a major change affecting a reservation, product, or event, and if Café de l’Homme is aware in advance, every effort will be made to inform clients as soon as possible and adjust the booking accordingly.

Order Processing

To ensure a booking is duly processed by Café de l’Homme, clients must fill out the required forms, completing all mandatory fields.

No reservation or order will be confirmed without this information. Therefore, we strongly recommend using the names and fields provided in our official publications to avoid any errors.

In the event of mistakes or inaccuracies in the information provided by the client, Café de l’Homme disclaims all responsibility regarding any resulting consequences on the reservation or order.

Lastly, Café de l’Homme’s automated recording systems shall constitute proof of the nature and date of the concluded contract.

Order Confirmation

Every order binds Café de l’Homme only after written confirmation is sent by email.

In cases of force majeure or exceptional circumstances, Café de l’Homme may be unable to honor its commitments regarding the order. No claims will be accepted on this basis.

Café de l’Homme reserves the right not to follow through with certain orders, without being required to justify the reasons. In such cases, the client will be informed by email of the non-confirmation of their order.

Delays – Late Arrivals

To ensure quality service, Café de l’Homme aims to respond to requests within two business days from the time of order confirmation. This is a non-contractual timeframe and cannot be used as grounds for a claim.

If the client does not receive the expected services, they may, as an exception, contact Café de l’Homme’s Reservations service during business hours to request a duplicate voucher or confirmation, subject to identity verification.

Delivery times stated on our communication platforms are shared in good faith and are non-binding. No penalty for delay will be applicable. In case of dispute, the email used to send the voucher will be used as reference.

If the client fails to collect the services or vouchers at the agreed date, no refund will be granted (NO SHOW).

Please note that if a client arrives more than 20 minutes late, the reservation will be considered forfeited, and no claim will be accepted. The original reservation terms may be adjusted on-site depending on restaurant activity.

Café de l’Homme declines all liability for delays due to traffic or road congestion in Paris, especially during rush hours. It is the client’s responsibility to allow enough time to arrive punctually.

As such, no compensation, refund, or rescheduling will be granted if the client fails to arrive at their designated time.

Limitations of Liability

Café de l’Homme shall in no event be held liable for any losses or damages, whether anticipated or not, arising from:

  • loss of data,
  • loss of income or anticipated profits,
  • loss of business or opportunity,
  • loss of intangible assets or reputational harm,
  • damages incurred by third parties,
  • or any indirect, consequential, special, or exemplary damages resulting from use of the site, regardless of the cause or form of action.

Regarding service bookings, Café de l’Homme disclaims all responsibility for injuries, losses, delays, irregularities, debts, or expenses suffered by clients or their belongings, resulting from failures by any supplier, transporter, or third-party service provider.

Moreover, neither Café de l’Homme nor its service providers shall be held responsible for events beyond their control, such as:

  • illnesses, theft, social conflicts,
  • technical breakdowns, extreme weather conditions,
  • acts of war, terrorism, or government restrictions,
  • transportation failures or any accidental or fortuitous incident.

No damage, loss, or dispute arising from the use of the site may give rise to a claim against Café de l’Homme. The same applies to incidents occurring during clients’ stays, including any hotel cancellations, thefts, strikes, or external restrictions.

Furthermore, Café de l’Homme cannot be held jointly liable for unforeseen personal expenses, delays, or governmental decisions that would change the initial contract conditions.

If any provision of these terms is found to be illegal, invalid, or unenforceable, it shall be removed without affecting the validity of the remaining clauses, which shall remain fully in effect.

Terms of Use

By accessing the Café de l’Homme website, you agree not to perform, encourage, or facilitate any of the following actions:

  • Harass, threaten, or harm others, including justifying or facilitating any form of harassment or surveillance.
  • Send or distribute unsolicited content: spam, chain letters, pyramid schemes, mass surveys, or any other bulk messaging, whether commercial or not.
  • Create a conflict of interest, including by exchanging commercial reviews or posting false opinions.
  • Promote hatred, discrimination, or any form of intolerance against protected categories.
  • Infringe on the rights of others, including:
    • Right to privacy,
    • Copyright, trademark, patent, trade secrets,
    • Right to image, privacy, or any other intellectual property rights.
  • Distribute illegal or pornographic content.
  • Collect personal data on minors or threaten them in any way.
  • Use automated tools (bots, scrapers, extractors, etc.) to access, index, or exploit the website or its content.
  • Attempt unauthorized access to the site, user accounts, or connected systems through hacking, password decryption, or similar methods.
  • Transmit viruses, trojans, defects, or any malicious software.
  • Disrupt the operation of the website in any way, including by intentionally overloading traffic.
  • Violate network security, decrypt passwords or security keys.
  • Remove, bypass, or disable security mechanisms on the site or those limiting the copying of its content.

Any complaint regarding services must be sent by registered letter within a maximum of 8 days after receipt to:

Copyright & Intellectual Property

All content on the site (texts, images, videos, drawings, logos, music, URLs, prices, etc.) is the exclusive property of Café de l’Homme or its partners. Any reproduction, storage, or use for commercial purposes, even partially, is strictly prohibited without written authorization.

These elements are protected by French copyright laws as well as the U.S. Copyright Act of 1976 (Title 17).

Jurisdiction

All contracts are governed by French law, and any dispute will fall under the jurisdiction of the courts of Paris, notwithstanding any contrary clause or specific condition agreed individually.
